Measures to Support Customers Affected by Extreme Weather Events
Following particularly severe weather events that have occurred throughout the country and the related declarations of a state of emergency adopted by the competent authorities, the Bank is making specific financial support measures available to customers residing in or having their headquarters in the affected areas.
In accordance with current regulations and the provisions issued by the Civil Protection Agency and other competent authorities, the Bank allows customers to request a suspension of payments on mortgage installments and other outstanding financings, under the conditions and in accordance with the procedures outlined in the individual regional notices.
These measures apply exclusively to individuals and territories identified in the official declarations of a state of emergency and in accordance with the procedures outlined below.
Scope of Application
Pursuant to the individual ordinances, the suspension may be granted to:
- individuals or businesses holding mortgages on evacuated or damaged buildings;
- businesses holding mortgages related to the Management of commercial and economic activities—including agricultural activities—carried out in evacuated or damaged buildings;
- individuals holding mortgages related to the management of agricultural activities carried out on land affected by exceptional natural disasters.
Procedures and Effects of the Suspension
The suspension of mortgage installment payments may take place, depending on the option chosen by the customer, in the following alternative ways:
- suspension of the entire installment: at the end of the suspension period, repayment of the installments will resume, starting with the suspended ones and continuing with the remaining installments in the previously defined order, with a corresponding shift in the amortization schedule and its consequent extension for a duration equal to that of the suspension. In the case of index-linked financing, the interest rate applied upon resumption of repayment will be calculated based on the value of the indexing parameter in effect at the time of resumption. The payment of non-delinquent interest, accruing on the principal during the suspension period (at the contractually agreed-upon rate), will be spread over the entire remaining repayment schedule, beginning with the first installment following the resumption of amortization, through additional periodic payments in addition to the regular installments and with the same frequency as those installments, in an amount equal, for each installment, to the total sum of such interest divided by the number of remaining installments in the amortization schedule;
- Suspension of the principal-only portion: For all installments falling within the suspension period, the Customer will pay, on the original due dates, an interest portion equal to the interest pertaining to the suspended installment, subject to changes in the reference parameters. Repayment of the principal portions of the suspended installments will resume starting with the suspended ones and will continue with the remaining installments in the previously defined order, with a corresponding shift in the amortization schedule and its consequent extension for a duration equal to that of the suspension.
The suspension does not entail:
- the application of fees or processing charges;
- a change in the rates or spreads applied to the mortgage or finance lease;
- a request for additional guarantees.
Failure to pay the full installment during the suspension period is exempt from compensation for damages in the form of late payment interest.
Failure to pay or late payment of the interest portion—where the Customer has opted to suspend only the principal portion—will result in the application of late payment interest limited to the interest portion.
During the suspension period, interest will continue to accrue at the contractual rate and must be repaid in accordance with the procedures outlined above, depending on the option chosen.
In any case, all obligations, agreements, conditions, and guarantees of the original loan agreement that are not incompatible with the statutory suspension and with the provisions of this document shall remain in effect.
No other changes will be made to the loan/finance lease agreement, and any novation effect is expressly excluded.
Duration of the Suspension
The suspension shall remain in effect as long as the buildings in question remain unusable or uninhabitable and, in any case, no later than the termination of the state of emergency. For agricultural activities carried out on land affected by natural disasters, the suspension shall in any case not extend beyond the date of termination of the state of emergency.
Application for Suspension and Deadlines for Submission
The request for suspension of mortgage payments must be accompanied by the self-certification form regarding the damage sustained (“Self-Certification for Mortgage Payment Moratorium”) submitted in accordance with Presidential Decree No. 445 of December 28, 2000, as amended and supplemented.
The request form must be sent to the Bank via certified email (PEC) to the following address: bancasistema@legalmail.it, signed by the Customer with a digital signature.
Customers may submit requests for suspension within the deadlines specified from time to time in the relevant regional notice.
